This website is intended for users over the age of 18. You agree not to use the site for any unlawful or prohibited purpose.
2. Intellectual Property
All images, text, graphics, and content on this site are the intellectual property of Shanna Mae Photography and may not be used, copied, or distributed without express written permission.
3. Booking & Payment
Session dates are reserved on a first-come, first-served basis. A non-refundable retainer fee is required to hold your date. Final payment terms will be outlined in your individual contract.
4. Rescheduling & Cancellations
You may reschedule with at least 72 hours' notice, subject to availability. Cancellations made less than 72 hours in advance may forfeit the retainer.
5. Service Refusal
We reserve the right to refuse service to anyone for any reason at any time, especially in the case of abusive or inappropriate behavior.
6. Liability
While we strive for perfection, we are not liable for circumstances beyond our control, such as weather conditions, technical failures, or client unpreparedness that may affect the final outcome.
7. Governing Law
These terms shall be governed by the laws of the State of Montana.
8. Changes to Terms
We reserve the right to update or modify these terms at any time without prior notice. Please review periodically.

Disclaimer

We promise to:
-Deliver high-resolution, professionally edited images in the time frame outlined in your contract.
-Offer a memorable, customized photo experience tailored to your session type.
-Make reasonable efforts to accommodate location, lighting, and posing requests.
This guarantee applies under the following conditions:
-Clients arrive on time and prepared for their session.
-Weather or environmental factors are outside of our control.
-Requests for reshoots due to styling, location changes, or personal preferences (not related to quality) are not covered.
-Creative direction is trusted during the session.

If there is an issue with the technical quality of your images, please reach out within 7 days of delivery, and we will review your case.

conditional Guarantee 

At Shanna Mae Photography, we reserve dedicated time and resources for each session—often setting aside half a day. Because availability is limited, we maintain a firm cancellation policy.

Clients may cancel their session within 7 days of signing the contract for a full refund. After that window, cancellations are non-refundable, except in the case of genuine emergencies. Thank you for understanding and respecting our time.

Clients have 3 days to complete this contract. If not completed within that timeframe, your session date and time may be released and made available to other clients.

If Shanna Mae Photography is unable to fulfill the contract due to an emergency, illness, natural disaster, or any cause beyond our control (e.g. fire, equipment failure, postal loss), all fees paid will be refunded in full, and no further liability will apply. This limitation of liability also covers situations where images are lost or damaged through no fault of the photographer.

In the rare event of failure to perform for any other reason, our maximum liability is limited to the total amount paid by the client.

refunds

All photographs, images, and content created by Shanna Mae Photography are the exclusive property of the photographer, protected by copyright law. Upon completion of your session, you will receive a license to use the images for personal or commercial purposes as specified in the contract.
By working with Shanna Mae Photography, you agree to the following:
-Copyright Ownership: All images produced during your session remain the property of Shanna Mae Photography. Copyright is not transferred to the client unless specifically agreed upon in writing.
-Usage Rights: Clients are granted personal use rights to the images, which may include printing, sharing on social media, and using them for personal purposes. Commercial use, such as marketing, resale, or publication of the images, is subject to specific permissions and additional fees.
-Watermarking and Editing: Clients may not remove watermarks from images or alter them in any way (including cropping or editing) unless granted written permission. For professional editing or altering of images (such as in a promotional campaign), please contact the photographer.
-Social Media and Sharing: We encourage sharing your photos on social media! However, you are asked to credit Shanna Mae Photography whenever possible. Proper attribution helps ensure that others discover your photos and our work.
-Archiving: While we do our best to keep your images safe, Shanna Mae Photography is not responsible for any loss or damage to your images after they have been delivered.
